These Terms of Service ("Terms") govern your use of LMKwhen.com and related services (collectively, the "Service") operated by Updraft Labs LLC ("Updraft Labs," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
LMKwhen.com is a weather monitoring and alert notification service. The Service monitors user-defined geographic locations against weather data published by the National Weather Service (NWS), Storm Prediction Center (SPC), and other government sources, and delivers notifications when alert criteria are met.
You must be at least 18 years old to use the Service. By agreeing to these Terms, you represent that you are at least 18 years of age. If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@lmkwhen.com if you suspect unauthorized access to your account.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are used to abuse our notification delivery infrastructure.
The Service is offered on a tiered subscription basis:
Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel at any time through your account settings or the Stripe Customer Portal; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.
We reserve the right to change pricing with 30 days' notice. Existing subscribers will receive email notice before any price change takes effect.
Free trial. We may offer a time-limited free trial of a paid tier. Trials are one per organization and are non-transferable. At the end of a trial, your account reverts to the Free tier unless you have added a payment method and subscribed.

By configuring an SMS notification channel, you expressly consent to receive weather alert text messages from LMKwhen at the phone number you provide. You represent that you are the authorized user of that phone number.
Message frequency varies based on weather activity. Standard message and data rates may apply. To stop receiving messages, reply STOP to any message. To resume, reply START.
SMS is provided for informational purposes only and does not constitute emergency notification. Do not rely solely on SMS for emergency decision-making.
The Service relies on weather data from the National Weather Service API and other government sources. We do not generate, modify, or guarantee the accuracy, timeliness, or completeness of weather data.
Alert delivery depends on third-party services including Twilio (SMS), Amazon SES (email), and internet connectivity. We do not guarantee that every alert will be delivered, or that delivery will occur within any specific timeframe.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. UPDRAFT LABS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UPDRAFT LABS LLC AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROPERTY, PERSONAL INJURY, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES. IN SUCH JURISDICTIONS, THE ABOVE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless Updraft Labs LLC and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
The Service, including its software, design, and content (excluding weather data from government sources), is the property of Updraft Labs LLC and is protected by copyright and other intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or brand assets without prior written consent.
You may close your account at any time from your account settings. Upon termination, your right to use the Service ends immediately. We will retain your data in accordance with our Privacy Policy and applicable law.
We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Colorado, and you consent to personal jurisdiction in those courts.
We may modify these Terms from time to time. We will provide at least 14 days' notice before material changes take effect by posting the updated Terms on this page and emailing registered users. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
